Scott has been a litigator since 1986. He has extensive experience trying all types of cases in both state and federal courts. His experience and accomplishments in "general litigation" were recognized by Boston Magazine in 2006, when he was named a "Massachusetts Super Lawyer."
Scott has extensive employment litigation experience. In addition to litigating discrimination and other types of employment claims in state and federal court, Scott regularly represents employers before the MCAD. Although usually successful in terminating claims at the “probable cause” stage, Scott has conducted numerous “public hearings” and defended or prosecuted appeals before the Full Commission. Of note, one of Scott’s insurance company clients provided “employment practices liability” coverage to many automobile dealerships in Massachusetts. As a result, Scott defended a wide spectrum of employment claims against the dealerships before the MCAD and in state and federal courts, including one of the first “same-sex” discrimination cases brought in Massachusetts that was prosecuted by the EEOC. He has additionally represented employers at hearings before the Division of Unemployment Assistance. Finally, Scott has represented professional licensees before the Division of Professional Licensure.
In addition to employment litigation, Scott’s extensive litigation experience includes but is not limited to construction accident and construction defects cases, all types of tort cases, including wrongful death, motor vehicle, and premises liability, Chapter 93A claims, indemnification and “additional insured” claims, and Chapter 93A and “bad faith” claims, and insurance coverage disputes. He has litigated cases in both the state and federal courts. He has also argued cases before the Massachusetts Supreme Judicial Court and Appeals Court and has many reported cases, notably Lumber Mut. Ins. Co. v. Zoltek Corp., 419 Mass. 704 (1995) and Glidden v. Maglio, 430 Mass. 694 (2000). Finally, he has attended hearings or conducted depositions in 19 other jurisdictions.
In addition to his court room experience, Scott regularly arbitrates and mediates cases privately and through Court-sponsored Alternate Dispute Resolution. Scott serves as the Public Member and Secretary of the Board of Registration in Optometry, and was recently re-appointed to a second five-year term by Governor Deval Patrick. Scott has served as a Court-appointed GAL in both civil and criminal cases. He currently serves as the Vice President of the Plymouth County Bar Association. Finally, Scott has served as a panelist in legal seminars sponsored by MCLE and Lorman Education Services.
